1. Introduction

These Terms of Service ("Terms") govern your use of the Smart Teacher mobile application and web platform at smart-teacher.net (collectively, the "Service"), operated by KickstartCoders Ltd ("we", "our", or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

The Service is intended for use by educators, school administrators, students, and parents. You must be at least 16 years old (or the minimum age required in your jurisdiction) to create an account.

If you are using the Service on behalf of a school or organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate and complete information when creating your account
Keep your login credentials secure and confidential
Notify us promptly at info@kickstartcoders.com if you suspect unauthorised access to your account

4. Your Data

You retain ownership of all content and data you create or upload to the Service ("Your Data"), including classes, student records, lesson plans, grades, and files.

You grant us a limited licence to host, store, and process Your Data solely to provide and improve the Service. We will not sell, share, or use Your Data for any purpose other than operating the Service, as described in our Privacy Policy.

You are responsible for the accuracy and legality of the data you enter. If you enter personal data about students or other individuals, you are responsible for ensuring you have an appropriate legal basis to do so (such as legitimate interest or parental consent).

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorised access to the Service or its infrastructure
Interfere with or disrupt the Service or other users' use of it
Upload malicious content, viruses, or harmful code
Use automated tools (bots, scrapers) to access the Service without our written permission
Resell, sublicense, or redistribute the Service without our written consent
Impersonate another person or misrepresent your affiliation with any entity

6. AI Features

Smart Teacher includes AI-powered features (such as report generation and lesson planning). When you use these features, relevant teaching data is sent to our AI provider to generate the requested content. See our Privacy Policy for details on how this data is handled.

AI-generated content is provided as a starting point and may contain errors or inaccuracies. You are responsible for reviewing, editing, and approving all AI-generated content before using it in a professional context.

7. Subscriptions and Payments

Some features of the Service require a paid subscription. If you purchase a subscription:

Payments are processed securely by Stripe. We do not store your full payment card details.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
You may cancel your subscription at any time from within the app or by contacting us. Cancellation takes effect at the end of the current billing period.
We do not offer refunds for partial billing periods, except where required by law.

We reserve the right to change subscription pricing. We will give you at least 30 days' notice of any price increase before it takes effect.

8. Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. We may:

Perform maintenance that temporarily affects availability
Update, modify, or discontinue features at any time
Impose usage limits as part of your subscription plan

9. Termination

You may delete your account at any time from within the app (Settings → Delete Account). This will permanently delete your account and all associated data.

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Where possible, we will give you notice and an opportunity to address the issue before terminating your account.

10. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by KickstartCoders Ltd and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. Your right to use the Service is limited to the licence granted in these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, KickstartCoders Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or £100, whichever is greater.

12. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that AI-generated content will be accurate or complete.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
